1. Overview

This website is operated by Tyler McDaniel Golf Bags, a sole proprietorship doing business as Tyler Golf Bags ("we", "us", "our"). Throughout the site, the terms "you" and "your" refer to you, the user or customer.

By visiting tylergolfbags.com or purchasing from us, you agree to be bound by these Terms of Service, including the additional terms and policies referenced here and available by hyperlink. These Terms apply to all users of the site, including browsers, customers, and content contributors.

If you do not agree to all the terms of this agreement, please do not use this website or purchase from us.

2. Eligibility

You must be at least the age of majority in your state or province of residence to purchase from this site. You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including copyright laws) in using our service.

3. Products and pricing

All prices are listed in United States Dollars (USD) and are subject to change without notice. We reserve the right to modify or discontinue any product at any time.

We have made every effort to display product colors and images as accurately as possible. We cannot guarantee that your monitor's display of any color will be accurate. Product images are representative; minor variation in materials, stitching, and hardware finish is normal for our products and is not a defect.

Product availability is not guaranteed. In the event an item is listed at an incorrect price or with incorrect information due to a typographical error, we reserve the right to refuse or cancel any order placed for that item, whether or not the order has been confirmed and your payment method charged. If your payment method has already been charged and we cancel the order, we will issue a refund in the amount of the charge.

4. Custom and personalized products

Custom, personalized, and made-to-order products, including bags with embroidered names, logos, club or team branding, or customer-supplied artwork, are produced specifically for you.

By submitting artwork, a logo, or any other material for use on a custom product, you represent and warrant that you own the rights to that material or have obtained permission from the rights holder to reproduce it. You agree to indemnify and hold us harmless from any claim arising from our reproduction of material you supplied. We reserve the right to decline any custom order for any reason, including suspected infringement of a third party's trademark or copyright.

We will provide a digital proof for approval before production on custom orders. Once you approve a proof, production begins and the order cannot be changed or cancelled. Custom orders are not eligible for the standard 30-day return unless the item arrives with a manufacturing defect or does not match the approved proof.

5. Orders and payment

Receipt of an order confirmation email does not constitute our acceptance of your order. We reserve the right to accept or decline any order, and to limit quantities purchased per person, per household, or per order.

You agree to provide current, complete, and accurate purchase and account information for all purchases. You agree to promptly update your account and payment information so that we can complete your transactions and contact you as needed.

6. Returns, refunds, and warranty

Our Return and Refund Policy and warranty terms are incorporated into these Terms by reference and are available at tylergolfbags.com/policies/refund-policy.

7. Shipping and risk of loss

Our Shipping Policy is incorporated into these Terms by reference. Title and risk of loss for products pass to you upon our delivery to the carrier.

8. Intellectual property

All content on this site, including text, graphics, logos, product designs, photographs, and software, is the property of Tyler McDaniel Golf Bags or its content suppliers and is protected by United States and international copyright and trademark law. You may not reproduce, duplicate, copy, sell, or exploit any portion of the site or our product designs without our express written permission.

Our site may include links to third-party websites and relies on third-party services for payment processing, fulfillment, and analytics. We are not responsible for the content, accuracy, or practices of third parties. Please review their policies before engaging with them.

10. Disclaimer of warranties

Except for the express 365-day warranty against manufacturing defects described in our Return and Refund Policy, our products and this service are provided "as is" and "as available" without any representation, warranty, or condition of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

We do not warrant that the service will be uninterrupted, timely, secure, or error-free, or that the results obtained from use of the service will be accurate or reliable.

11. Limitation of liability

To the maximum extent permitted by law, in no case shall Tyler McDaniel Golf Bags, its owner, employees, affiliates, agents, contractors, suppliers, or service providers be liable for any indirect, incidental, punitive, special, or consequential damages arising from your use of the service or any products purchased. Where liability cannot be excluded, our total liability shall not exceed the amount you paid for the product giving rise to the claim.
